The High Court found that the trial magistrate committed two fundamental procedural irregularities: (1) failure to read and explain the substance of the charge and take a fresh plea when the hearing commenced de novo, and (2) wrongful admission of the P3 form through a witness who was not its maker despite the appellant's objection. These irregularities went to the root of the trial and rendered the entire proceedings a nullity. The omission to take a fresh plea was fatal and not curable under section 382 of the Criminal Procedure Code.
