The High Court found that the Kadhi's Court lacked jurisdiction to determine and distribute matrimonial property between the parties, as such jurisdiction is not conferred by Article 170(5) of the Constitution or the Kadhi's Courts Act. Matrimonial property disputes involving Muslims must be determined by the High Court or magistrate's court, applying Islamic law if the parties so choose, as provided under Section 3 of the Matrimonial Property Act.
