The mere filing of a notice of appeal or an application for leave to appeal out of time does not suffice. Even if the application were competent, the applicant failed to demonstrate that he would suffer substantial loss or that he had provided or was willing to provide security as required by law. The intended appeal was also belated, and there was no evidence of leave having been granted to file it out of time. Consequently, the application lacked merit and was dismissed with costs...
