The appeal succeeded only on quantum because the trial court's award of Kshs. 300,000 for the respondent's soft tissue and shoulder injuries was not justified by the comparable authorities cited. The appellate court found the lower award excessive, but also found the appellants' proposed figure too low. It therefore substituted the general damages award with Kshs. 200,000, while leaving special damages and costs of the lower court intact.
