Procedural Posture

Injunction Application / Ruling on Interlocutory Application

  1. 1 Whether the Plaintiff has established a prima facie case to warrant the grant of a temporary injunction restraining the Defendant from interfering with Plot No. 535 Mazeras.
  2. 2 Whether the Plaintiff has exhausted the dispute resolution mechanisms under the Land Adjudication Act before approaching the court.

Ratio Decidendi

The court found that the Plaintiff had not demonstrated a prima facie case for the grant of a temporary injunction. The Plaintiff's claim was complicated by the fact that the disputed land, Plot No. 900, was created from the original Plot No. 535 through an adjudication process, and the Land Adjudication Committee had already ruled in favour of the Defendant. The Plaintiff had not shown that he had exhausted the dispute resolution mechanisms under the Land Adjudication Act, which include an appeal to the Minister. Given these circumstances, the court held that it was not satisfied that the Plaintiff was entitled to the injunctive relief sought.
