Furthermore, the DPP lacked legal authority to direct the continuation of prosecution against the applicant because there was no certificate of fitness to plead from a medical officer, as required by section 163 of the Criminal Procedure Code. The medical report from Mathari National Teaching and Referral Hospital clearly stated that the applicant was unfit to plead and unlikely to recover to a state fit for trial.
