Ratio Decidendi

The court found that the appellant, SMP Capital Limited, was merely a financier of the 2nd defendant in the primary suit and had no operational control or vicarious liability regarding the motor vehicle involved in the accident. The evidence that the appellant was only a financier was not rebutted by the respondents. The court held that an effective decree could be passed in the primary suit without the appellant's participation, and thus the appellant was not a necessary party. The trial magistrate erred in failing to strike out the appellant from the suit at the preliminary stage. The appeal was therefore meritorious, and the suit against the appellant was struck out with costs.
