The Court of Appeal held that while the appellant failed to prove valid reasons for the respondent's dismissal, rendering the termination unlawful, the evidence demonstrated that the appellant afforded the respondent adequate opportunity to be heard in accordance with the law. The respondent's own conduct, including bringing unauthorized persons to the disciplinary hearing and failing to attend rescheduled hearings, thwarted the disciplinary process. The trial court erred in awarding the maximum compensation without considering the respondent's conduct and other relevant factors under section 49(4) of the Employment Act. The appellate court therefore set aside the award of 12 months'...
