Legal Issues
- 1 Whether the applicant is eligible for sentence revision having served only two and a half years of an eight-year sentence.
- 2 Whether the application for revision is premature under the applicable guidelines.
Ratio Decidendi
The court found that the applicant had only served two and a half years of an eight-year sentence, making the application for sentence revision premature. The court emphasized that revision is appropriate only where the inmate has served a significant portion of the sentence, specifically where only three years remain or where the sentence was three years or less. As such, the application did not meet the threshold for consideration, and the court declined to grant the revision sought.
Court Disposition
Application dismissed as premature.
Orders
- Application for sentence revision is dismissed as premature.
- Prison officers to comply with court instructions regarding availing files for eligible inmates.
