Ratio Decidendi

The court found that the applicant's claim to the suit land was based on a sale agreement entered into before the confirmation of grant in the relevant succession cause, in direct contravention of Section 55 of the Law of Succession Act. Such a transaction is void and constitutes intermeddling under Section 45 of the Act. The court held that its discretion to order joinder of parties cannot be exercised in favour of a party whose claim is founded on an illegality. Since the applicant's interest in the proceedings was premised on a transaction that is null and void in law, she is not a proper party for joinder. The application for joinder was therefore dismissed with costs.
