The High Court determined that it no longer has jurisdiction to hear and determine disputes relating to ownership, occupation, and title to land following the promulgation of the 2010 Constitution and the operationalization of the Environment and Land Court. The transitional period allowing the High Court to conclude pending land matters ended over ten years ago. As jurisdiction is strictly conferred by the Constitution or statute, and cannot be assumed by the court, the High Court must down its tools where it lacks jurisdiction. Consequently, the matter must be placed before the Environment and Land Court for further consideration.
