The court found that some of the acts alleged to be contemptuous occurred before the issuance of the court order and that there was no evidence of formal service of the order on the Interested Party. Upon learning of the order, the Interested Party ceased any further dealings with the land. The land in question had been compulsorily acquired by the National Land Commission, and the compensation award was being preserved for distribution among the beneficiaries. As such, the land no longer formed part of the deceased's estate, and the interim inhibitory order had been overtaken by events.
