The High Court found that while the offence of grevious harm is serious and carries a maximum sentence of life imprisonment, the trial magistrate failed to consider the appellants' mitigation and the absence of previous convictions. The court held that the maximum sentence should be reserved for the worst offenders, and the appellants did not fall into that category. Consequently, the sentence of life imprisonment was manifestly excessive. The court exercised its discretion to interfere with the sentence, setting aside the life imprisonment and substituting it with a sentence of six years' imprisonment from the date of conviction.
