Tribunal Claim / Judgment

  1. 1 Whether the Claimant resigned or was expelled from the Sacco.
  2. 2 Whether the Claimant is entitled to a refund of his savings and share contributions.
  3. 3 Whether the Claimant owes the Respondent any money in the form of a loan.

Ratio Decidendi

The Tribunal found that the Claimant had resigned from the Respondent Sacco and was not expelled. The Claimant was entitled to a refund of his savings and share contributions, but only after deducting any outstanding loan liabilities. The evidence established that the Claimant owed the Respondent Kshs.100,000 in loans. The Tribunal rejected the claim for loss of income, finding no evidence of expulsion or wrongful barring from business by the Respondent. The Tribunal thus awarded the Claimant a refund of Kshs.500,000, being the net entitlement after set-off, and granted costs and interest at court rates. The claim for damages for loss of income was dismissed.
