The Tribunal found that the lease agreement, though for fifteen years, contained a termination clause allowing the lessee to terminate upon sixty days' notice, bringing it within the definition of a controlled tenancy under Section 2 of Cap 301. The Tribunal held that the declaration by the Kenya National Highways Authority that the premises was on a road reserve constituted a force majeure event not anticipated by the parties, partially frustrating the lease. Consequently, it would be unjust to require the Tenant to pay rent in lump sum for four years while the ELC Petition regarding demolition was pending.
