The Supreme Court determined that it lacked jurisdiction to entertain the application because the substantive appeal before the Court of Appeal had not yet been heard and determined. There was no determination of any constitutional question by the Court of Appeal to warrant the invocation of the Supreme Court's jurisdiction under article 163(4)(a) of the Constitution. The application was therefore premature, and any involvement by the Supreme Court at this stage would be improper, as it would entail commenting on issues yet to be adjudicated by the Court of Appeal.
