The Supreme Court held that it lacked jurisdiction to entertain the appeal as the appellant failed to specify under which limb of article 163(4) of the Constitution the appeal was brought, a mandatory requirement for invoking the Court's appellate jurisdiction. Nevertheless, in view of the public interest and the need to provide jurisprudential guidance, the Court addressed the substantive issues.
