Ratio Decidendi

The act of the returning officer announcing the results and issuing a certificate to the winner constitutes publication for the purposes of the statutory time limit. The court reasoned that if Parliament intended to restrict publication to gazettement, it would have expressly stated so in the statute. Therefore, the election inquiry was not incompetent for being filed before gazettement, as the relevant date for publication is when the results are announced and the certificate is issued. The appeal was dismissed as lacking merit.
