Ratio Decidendi

Although the respondent had a valid contractual and statutory basis to terminate the claimant's employment on medical grounds due to incapacity exceeding the threshold in the employment contract, the respondent failed to comply with the mandatory procedural requirements under section 41 of the Employment Act. The claimant was not afforded an opportunity to be heard or to defend himself in the presence of another employee or union representative. The contract clause permitting termination without notice cannot override statutory procedural protections. As a result, the termination was substantively justified but procedurally unfair, entitling the claimant to compensation as provided by law.
