Ratio Decidendi

The court found that the applicant had demonstrated due diligence in seeking to appeal the ruling of 27th July 2012, as the delay was explained by the late receipt of the ruling. The applicant was entitled to a right of appeal under the Civil Procedure Rules, and the interests of justice required that the applicant not be denied this right. The court exercised its discretion to enlarge time for filing the appeal and granted a stay of proceedings to preserve the subject matter of the intended appeal.
