Ratio Decidendi

The court found that although the appellant had deposited the decretal sum in compliance with the court's earlier order, the appellant had failed to prosecute the appeal for an inordinate period, thereby prejudicing the respondent. Nevertheless, since the stay of execution was still in place and the deposit had been made, the court allowed the application for stay on condition that the appellant fixes the hearing of the appeal within 60 days. Failure to comply would result in automatic dismissal of the appeal and release of the decretal sum to the respondent. The court balanced the interests of both parties by maintaining the stay but imposing a strict timeline for prosecution of the appeal.
