The court held that the cause of action for breach of the sugarcane outgrower contract accrued when the appellant failed to harvest the plant crop on or before 13/10/2011, not at the end of the five-year contract period. Accordingly, the six-year limitation period under section 4(1) of the Limitation of Actions Act began to run from the date of the breach. Since the respondent filed the suit on 7/2/2018, more than six years after the breach, the suit was statute barred. There was no evidence that the respondent sought or obtained leave to file the suit out of time.
