Ratio Decidendi

The High Court found that the respondent's suit was filed outside the six-year limitation period prescribed for contractual claims under Section 4(1)(a) of the Limitation of Actions Act. The contract was entered into on 20th February 1996, and the breach (failure to harvest the plant crop) occurred when the crop matured, which was by 20th February 1998. The respondent filed suit on 15th September 2004, more than six years after the cause of action accrued. The court held that the suit was statutorily time-barred and that the trial court lacked jurisdiction to entertain it. Consequently, the appeal succeeded, and the respondent's suit was dismissed.
