Ratio Decidendi

The court found that the Kimilili Court had jurisdiction to hear the matter under Section 3(2) of the Magistrates Court Act, and that Section 15 of the Civil Procedure Act does not limit the jurisdiction of a Resident Magistrate’s Court. The court further held that since judgment had already been entered in Kimilili RMCC No.96 of 2006 and the conditional order for setting aside that judgment had lapsed due to non-compliance, the judgment remained in force. As a result, the suit was concluded and could not be transferred, as such transfer would serve no purpose. The application for stay and transfer was therefore dismissed with costs.
