The Court of Appeal found that the applicant had satisfied the dual requirements for the grant of a stay of execution under Rule 5(2)(b): first, that the intended appeal was arguable and not frivolous, and second, that the appeal would be rendered nugatory if a stay was not granted. The court considered the grounds of the application, the supporting and replying affidavits, and the fact that the appeal had already been filed and was awaiting a hearing date. The court concluded that, in all the circumstances, it was just to grant a stay of execution of the superior court's ruling pending the determination of the appeal. Costs of the application were ordered to abide the outcome of the appeal.
