The court held that the funds deposited in the joint account as security for execution of the trial court’s judgment must be released to the applicant following the successful appeal, as the condition for the stay lapsed with the delivery of the appellate judgment. The existence of a pending appeal to the Supreme Court does not justify continued withholding of the funds in the absence of a stay order from that court. Procedural defects in the supporting affidavit were cured by a supplementary affidavit, and the joinder of parties was regularized.
