Ratio Decidendi

The court found that the purpose of security deposited pursuant to a stay of execution pending appeal is to guarantee the due performance of the decree should the appeal fail. Since the appeal was dismissed and there is no stay order or further appeal challenging the dismissal, the natural consequence is the release of the security to the decree-holder. The mere pendency of an application for reinstatement of the appeal does not, in the absence of a stay, bar the successful party from enjoying the fruits of judgment. Therefore, the Respondent is entitled to the release of the decretal sum deposited in court as security.
