Ratio Decidendi

The court found that while the appellant disclosed an inability to furnish cash security, the law requires security to assure due performance of the decree should the appeal fail. To balance the interests of both parties, the court ordered that half of the decretal amount be deposited in an interest earning account in the names of counsel for the parties, and the other half be secured by a bank guarantee. This arrangement was deemed fair and sufficient to protect the respondent's interests while accommodating the appellant's financial position.
