Ratio Decidendi

The court found that although it could not at this stage assess the overwhelming chances of success of the appeal, exceptional circumstances existed to justify granting bail pending appeal. These included the likelihood that the applicant would serve the custodial sentence before the appeal is heard, the applicant's six months of pre-conviction remand custody, and the fact that the applicant had surrendered the sum of Kshs.100,000/- to his superiors for onward transmission to the complainant. The court concluded that denying bail would render the appeal nugatory and that the applicant had established a case for bail pending appeal.
