As such, there is nothing to stay under Order 42 Rule 6 of the Civil Procedure Rules. The court relied on established jurisprudence that negative orders cannot be stayed because they do not require any party to do or refrain from doing anything. Consequently, the application for stay of execution was found to be incompetent and was dismissed with costs.
