The court found that the memorandum of appeal the applicant sought to regularize had already been struck out by a judge of concurrent jurisdiction for being filed out of time. There was no evidence that the previous order had been stayed or overturned on appeal. The applicant's attempt to re-litigate the same issue amounted to an abuse of the court process, as this court could not sit on appeal over a decision of another judge of equal jurisdiction. The applicant had not demonstrated sufficient cause for the extension of time, and the application was therefore devoid of merit. The Notice of Motion dated 9th November 2017 was dismissed with costs to the respondent.
