Ratio Decidendi

The Court of Appeal held that, regardless of the seller's mental capacity, the transaction for the sale of 0.5 acres of agricultural land was void for all purposes because the parties failed to obtain Land Control Board consent within six months of the agreement as required by section 6(1) of the Land Control Act. The subsequent consent obtained more than three years later was invalid and could not validate the transaction. The court found that the statutory requirements were mandatory and non-compliance rendered the agreement unenforceable. Consequently, the appeal was dismissed and the High Court's decision upheld.
