The court held that the Deputy Registrar erred in wholly rejecting the applicant's claim for commission (fees) in the bill of costs on the basis that no sale occurred. The correct approach, as per paragraph 7 of the Fourth Schedule, Part II of the Auctioneers Rules 1997, is that where requisite notices are served and the sale is stayed or postponed, the auctioneer is entitled to one half of the fees he would have earned after sale, calculated on the amount instructed to recover. The court found that the appropriate value for this calculation was Kshs.34,641,085/-, being the amount the applicant was instructed to recover, not the higher property valuation or the alleged settlement amount....
