Ratio Decidendi

The High Court found that the trial magistrate expressly ordered the sentences for the three counts to run concurrently. However, since the appellant was already serving another sentence at the time of conviction, the new sentences would only commence upon completion of the prior sentence, in accordance with section 15(3) of the Criminal Procedure Code. The period spent in custody prior to conviction was not to be credited because the appellant was serving a different sentence during that time. The appeal was therefore dismissed, and the sentences as imposed by the trial court were upheld, to run concurrently with each other but consecutively to the earlier sentence.
