Ratio Decidendi

The court held that under Order 42 Rule 6(1) of the Civil Procedure Rules, a stay of execution pending appeal can only be granted in respect of the decree or order appealed from. In this case, the appellant had not appealed against the decree being executed, but rather against the dismissal of his application for review. Therefore, even if the appellant succeeded in his appeal, it would not affect the decree that the respondent sought to execute. As such, there was no legal basis for granting a stay of execution, and the application was dismissed with costs to the respondent. The stay order previously issued was set aside and vacated.
