The court found that, upon consideration of the evidence of the 10 prosecution witnesses and the submissions made, the prosecution had established a prima facie case against both accused persons. The court held that at this stage, it is not required to analyze the credibility or weight of the evidence in detail, but only to determine whether there is sufficient evidence on which a reasonable tribunal could convict if no explanation is offered by the defence. The court rejected the 1st accused's argument that he was not placed at the scene and that the evidence was merely circumstantial, finding that the prosecution's evidence as a whole was sufficient to require both accused to be placed...
