Ratio Decidendi

The court, after considering the mitigation advanced by the accused and his counsel, the fact that the accused is a first offender, and the circumstances under which the offence resulting in loss of life was committed, determined that a custodial sentence was appropriate. In accordance with Section 333(2) of the Criminal Procedure Code, the court ordered that the period the accused had already spent in remand custody since his arrest on 22/10/2017 be taken into account in computing the five-year term of imprisonment. This approach ensures both the punitive and rehabilitative aspects of sentencing are balanced, while also adhering to statutory requirements regarding remand time.
