The Respondent admitted to instructing the Claimant not to report to work and did not make reasonable efforts to recall her or communicate directly regarding her employment status. Furthermore, the Respondent did not comply with the mandatory procedural requirements of Section 41 of the Employment Act, as the Claimant was not given an opportunity to be heard or to respond to the allegations before dismissal.
