However, the appellant, who claimed to be the deceased's son, was not given an opportunity to participate in the succession proceedings before the Kadhi's Court. The trial court proceeded on the assumption that only the widow and daughter were beneficiaries, as the matter was undefended. The High Court held that the interests of justice required the appellant to be given a chance to present his case and that the question of his entitlement to inherit could only be determined after a full hearing....
