Procedural Posture

Extension of Time Application / Ruling on Application for Extension of Time to File Appeal

  1. 1 Whether the applicant has provided sufficient reason for the delay in filing the appeal.
  2. 2 Whether the delay in filing the appeal was inordinate or excusable.
  3. 3 Whether the intended appeal has any prospects of success.

Ratio Decidendi

The court found that the delay in filing the appeal was not inordinate and was satisfactorily explained by the applicant's illness and the time taken to obtain court proceedings. Although the applicant did not file a draft memorandum of appeal, the court was satisfied from the affidavit and the impugned ruling that the intended appeal was not frivolous. The respondent did not demonstrate any prejudice that would result from granting the extension. Accordingly, the court exercised its discretion to extend the time for filing the memorandum of appeal and deemed the record of appeal filed on 22nd July, 2016 as properly filed.
