Ratio Decidendi

The court found that the respondent failed to demonstrate the existence of standard procedures that the claimant was alleged to have breached, nor did they provide evidence that such procedures were communicated to the claimant. Although the claimant was given an opportunity to be heard, the lack of a valid and substantiated reason for dismissal rendered the termination unfair under Sections 43 and 45 of the Employment Act. The court held that the respondent did not discharge its statutory burden to justify the dismissal, and therefore the claimant was entitled to compensation for unfair termination and payment in lieu of notice.
