Ratio Decidendi

The court found that it lacked jurisdiction to entertain the appeal because the Embu Provincial Appeals Committee had not rendered a decision. Section 8 of the Land Disputes Tribunals Act provides that only decisions of the Appeals Committee can be appealed to the High Court on points of law. Since no such decision existed, there was no valid appeal before the court. The court cited binding authority that jurisdiction must be established at the earliest opportunity and that without jurisdiction, the court cannot proceed. The appeal was therefore struck out and the matter declared disposed of.
