Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the Claimant deserted duty or was unlawfully terminated.
  2. 2 Whether the Claimant is entitled to the remedies sought.

Ratio Decidendi

The court found that the Respondent failed to demonstrate sufficient efforts to contact the Claimant or serve a notice to show cause regarding the alleged desertion. The evidence did not support the Respondent's claim of desertion, and the court was unconvinced that the Claimant absconded duty. Instead, the court accepted the Claimant's position that his employment was terminated without justifiable cause and in violation of procedural fairness. As a result, the termination was deemed unfair, entitling the Claimant to compensation, notice pay, and accrued leave, but not to salary for March 2016 or gratuity, as these were not proved or justified.

Court Disposition

Judgment for the Claimant in part.
