The Court of Appeal lacks jurisdiction to extend the 30-day period prescribed by section 23(4) of the National Assembly and Presidential Elections Act for filing an appeal from an election court decision. Rule 4 of the Court of Appeal Rules cannot be used to override or extend a statutory time limit, as the power to extend time must be expressly conferred by statute, which is not the case here. Even if the court had jurisdiction, the unexplained delay of 69 days in bringing the application would have led to a refusal to exercise discretion in favour of the applicant.
