Procedural Posture

Miscellaneous Application / Ruling on Application for Leave to Appeal Out of Time

  1. 1 Whether the applicant has shown sufficient cause for extension of time to file an appeal out of time.
  2. 2 Whether the intended appeal is arguable and not frivolous.
  3. 3 Whether the suit in the lower court has abated, rendering the application futile.

Ratio Decidendi

The court found that while the applicant satisfactorily explained the delay in seeking leave to appeal out of time, the underlying suit in the lower court had abated by operation of law since no application for substitution was made within one year of the defendant's death. As a result, there was no existing cause to pursue on appeal, rendering the application for extension of time futile. The court held that it would serve no purpose to enlarge time when the suit sought to be pursued is abated and non-existent. Consequently, the application lacked merit and was dismissed.
