Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the trial court erred in apportioning 100% liability to the appellant.
  2. 2 Whether the dependency ratio of 2/3 was properly adopted without proof.
  3. 3 Whether the award for loss of dependency was justified in the absence of evidence.

Ratio Decidendi

The High Court found that the trial magistrate correctly held the appellant 100% liable for the accident, as the respondents produced an eye witness and a police abstract, contrary to the appellant's assertions. However, the appellate court held that the respondents failed to prove dependency or the deceased's income, as no documentary evidence or birth certificates for dependants were produced, nor was the marital relationship established. Consequently, the award for loss of dependency was set aside. The awards for pain and suffering, loss of expectation of life, and special damages were upheld. The appeal thus partially succeeded, with each party bearing its own costs.

Court Disposition

Appeal partly succeeds.
