Procedural Posture

Election Petition / Ruling on Preliminary Objection and Notice of Motion to Strike Out Petition

  1. 1 Whether the affidavits in support of the petition were commissioned by an unauthorized person contrary to Section 4(1) of the Oaths and Statutory Declarations Act.
  2. 2 Whether the court has jurisdiction to entertain the application to strike out the affidavits and petition.
  3. 3 Whether the petition can proceed in the absence of valid affidavits.

Ratio Decidendi

The court found that the affidavits in support of the petition, including that of the petitioner and his witnesses, were commissioned by an advocate who, according to credible and current records from the Law Society of Kenya, was practicing in the same firm that drew and filed the petition. This contravened Section 4(1) of the Oaths and Statutory Declarations Act, which prohibits a commissioner for oaths from commissioning documents in matters where they are the advocate or have an interest. The court held that affidavits commissioned in breach of this provision are incurably defective and must be struck out. Without valid affidavits, the petition was unsupported and could not proceed....

Court Disposition

Petition struck out as incompetent for want of valid affidavits; preliminary objection dismissed; costs awarded to respondents.
