Procedural Posture

Employment Claim / Judgment

  1. 1 Whether the claimant is entitled to payment of terminal benefits as claimed.
  2. 2 Whether the respondent is entitled to deduct two months salary in lieu of notice from the claimant's terminal benefits.

Ratio Decidendi

The court found that the claimant was entitled to terminal benefits as claimed, based on the produced CBA. However, since the claimant resigned without giving the required two months' notice, the respondent was entitled to deduct the equivalent of two months' salary in lieu of notice from the terminal benefits. The net award to the claimant was therefore Kshs. 115,800, being the total terminal benefits less the notice pay deduction. The sum is payable with interest at court rates from the date of filing suit until payment in full, and the respondent is to pay the costs of the suit.

Court Disposition

judgment for the claimant, subject to deduction for notice pay

Orders

  • Judgment entered in favour of the claimant for Kshs. 115,800, being terminal benefits less two months salary in lieu of notice.
  • The sum awarded is payable with interest at court rates from the date of filing suit until payment in full.
