Ratio Decidendi

The court found that the trial magistrate failed to properly inquire into the circumstances of the identification of the appellant, particularly regarding the nature and adequacy of lighting at the scene. The identification evidence was not free from the possibility of error and was therefore unreliable. Additionally, the trial court did not adequately consider the appellant's alibi defence, and the prosecution did not attempt to rebut it as required by law. These failures rendered the conviction unsafe. Consequently, the court quashed the conviction and set aside the sentence, ordering the appellant's immediate release unless otherwise lawfully held.
