Notice of Motion Application / Ruling on Substitution of Deceased Defendant

  1. 1 Whether the applicant has provided sufficient legal basis to be substituted as the 1st defendant in place of the deceased.
  2. 2 Whether the applicant has demonstrated that he is the legal representative of the estate of the deceased 1st defendant as required by law.
  3. 3 Whether the estate is already adequately represented by the surviving co-administrator under section 81 of the Law of Succession Act.

Ratio Decidendi

The court held that substitution of a deceased defendant is only permissible where the applicant demonstrates legal representative status by producing documentary evidence such as letters of administration. The applicant, George Gaitho Chongo, failed to provide such evidence and only produced a death certificate. The court further found that the estate of the deceased 1st defendant is already represented by the 2nd defendant as a co-administrator under section 81 of the Law of Succession Act. Therefore, there was no legal basis for substitution, and the application was dismissed for lack of merit.
